ARTICLE I: HBS Membership


Anyone wishing to join must meet some minimal requirements:
1. Be 13 years of age or older
2. Must have X-Fire
3. Have a microphone or plan to purchase one within 30 days of signing up.
4. Be willing to participate in 1 of the weekly clan events.
5. Agree to follow all rules, within the constitution, and current laws enacted.

ARTICLE II: Conduct


1. While on team speak or the forums, all members are strictly prohibited to discriminate against other members and guests in any form.
2. While cursing in general is not restricted, it is inappropriate to direct curses at others.

ARTICLE III: Uniform Code


1. On team speak and supported game servers- <HBS>RANK NAME [Platoon and/or Dept ID]
2. On X-Fire- <HBS>Name

ARTICLE IV: Command


The Commanding Officer shall be responsible for the day to day operations of the clan and all duties therein. He shall have the power to appoint command officers of all lower levels, issue awards, promote, demote, and nominate Command Council Members. The Commanding Officer, cannot commit troops to war, but may raise the clan to defensive status if attacked. The HBS Commanding Officer can also Declare states of emergency, declare marshal law, enact Directives that must sunset within two weeks from enactment (or be re-affirmed by the Command Council), and issue Executive Orders.

The Executive Officer shall be responsible for the operations of the clan in the absence of the Commanding Officer and have the full authority to take temporary action. If the HBS Commanding Officer is on leave, then the HBS XO shall have full authority and those powers that the HBS XO has.

The HBS’s Deputy Executive Officer may be appointed by the HBS CO if he so deems fit or left vacant. The primary duties are to assist the CO and XO, and if necessary lead the clan.

Regiment/Department Command Officers- Are directly responsible for the day to day operations of there regiments. They may promote up to one rank at a maximum of 2nd Lieutenant, issue awards, and discipline the members of the regiment within.

ARTICLE V: Command Council


The Command Council shall consist of 8 Members…. 4 Elected by the Clan to serve a 4 month term and 4 Appointed by the Commander-in-Chief and confirmed by the Command Council as a whole.

The Commander-in-Chief Shall act as the President/Chairman of the Command Council and only vote in the cases of a tie. The President/Chairman has the right to veto any action of the command council. The veto may be overturned by a 3/4 majority vote of the command council.

The President Pro Tem shall be elected by the Command Council from within the membership to serve a 4 month term. In the absence of the President he shall assume all powers allotted by the President.

Department Commanding Officers, Regiment Commanding Officers and Special Forces CO may be appointed as Advisory Members to the council and be entitled to comment on any and all issues but not a vote.

The Command Council shall vote on important issues, and declarations of war. The Command Council by vote can remove standing orders of the Commander-in-Chief, and rescind any demotions, as they deem fit. The Command Council may also vote on General Directives, to make policy and rules for HBS that do not merit an official place in the constitution, but rather in the HBS Policy Book. The directives made by the council can have an indefinite expiration date. The Commander-in-Chief (aka President/Chairman) may terminate any General Directive, with a 5 day grace period. Finally the Command Council votes on amendments to the Constitution, as purposed.

Finally, Procedural Actions and Impeachments policies shall be established by Written Policy and Election Policies shall also be established by Policy.

ARTICLE VI: Chain Of Command


All officers in HBS are subject to a rank. In total there are 20 Ranks. At all times officers should use the Chain Of Command going to the next officer directly above him or her. In addition, the Diplomacy Department has a separate Non-Military Ranking System for the Ambassadors of HBS.

Any Orders issued by a superior officer are to be carried out unless they conflict with the HBS Constitution, An order issued by a higher ranking officer. If this happens; you should send a message to the person who gave you the order and explain why you cannot.


ARTICLE VII: Disciplinary Action


As stated above the Commander-in-Chief, and fellow Senior Staff Member’s are directly responsible for handing Disciplinary Action, while all extensive punishment bearing actions are required to be seen before the HBS Judicial System. Recruits shall not be protected, or offered the luxury of the Judicial System.

Upon executing a minor offense the following system shall be used as standard proto call but can be swayed from Violating the Constitution or an Order/Directive:
1st Offense- Warning
2nd Offense- Warning
3rd Offense- Punishable Action

Article VIII: New Regiments


HBS was built with the intent to support multiple games.

1. A new regiment may be formed, when recommended by the Commander-in-Chief and then by vote of the Command Council.
2. The Commander-in-Chief may grant Temp. Status while a vote is being taken.
3. All new regiments shall be on a temporary setup for the first 2 weeks.
3A: The Regiment may have a CO and an XO. The XO shall act as the Regiments Squad CO.
3B: After the 2 weeks is up, and if the membership count permits. The Regiment CO and XO are the main Command Officers for the Regiment and the first the Platoon may be formed only having a Platoon CO till the platoon is full (10 members) then at that time an XO may be appointed

ARTICLE IX: New Departments


HBS was built with the intent to support departments to aide with the daily operations of the clan.

1. A Department may be formed when a Command Council Member purposes one and then the entire Command Council votes on it as prescribed in the bylaws.
2. All new departments shall be under a 30 day probationary period, and then evaluated by HBS Command to determine the viability status.
3. All department internal layouts shall be established by Command Council Policy within seven days of Command Council approval.

ARTICLE X: Amendments


Amendments may be made to the constitution by first being considered by the Command Council and if passed by a three-froth majority vote the amendment would then be placed before the entire clan for ratification, requiring a three-froth majority vote as well for passage. Any amendment would not affect any issue or member that occurred before final ratification, and as the entire clan votes on the issue there shall be no grace period.

Amendment 1: Legal System


Section I.

HBS shall be allowed to create a Penal Code. Inside this Amendable Penal Code shall list offenses with detailed descriptions and a list of minimum and maximum punishments for each.

Section II.

It shall be hereby created the elected position of a Judiciary Officer (Justice Officer). This Officer will be responsible for upholding the Penal Code as stated, through policies set by the Command Council. This office is elected by the people of HBS for a term of 3 months with a limit of two terms. Also, the Command Council may impeach this person for misconduct with a 3/4 majority vote. Further policy shall be created by the Command Council to establish election procedures for this position.

Section III.

The Judicial Officer shall have the power to hear appeals on punishments, and overall guiltiness of crimes handed down by Central Command and the Senior Staff. The Judicial Officer may overturn in all or reduce punishment given on an unbiased basis. If Central Command feels the appeal was biased or extreme the issue and appeal shall be sent to the Command Council for a vote on the matter. During such time the member's original punishment shall remain in effect. If sent to the Command Council the meeting must be held within 48 hours.

Amendment 2: Election Reform


Section I:
The Command Council elections are to occur in a series of 3 administrative terms.

Section II:
The elections shall occur every other month starting in January 2006.

Section III:
There shall be 2 seats per election.

Section IV:
The first election, and all seats shall be agreed to by the Command Council.
